1. About Awesome Professionals
Awesome Professionals is an online marketplace operated by Awesome Professionals Ltd (“we”, “us”, “our”) that connects individuals and families (“Clients”) with independent professionals (“Professionals”) offering services including childcare, Special Educational Needs and Disabilities (SEND) support, social care, tutoring, and coaching.
Our platform is available at awesomeprofessionals.com (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms of Use (“Terms”).
We are registered in England and Wales. Our registered address and company number will be inserted here upon incorporation.
2. Acceptance of Terms
By registering an account, listing a service, posting a request, or otherwise using the Platform, you confirm that:
- You are at least 18 years of age;
- You have read, understood, and agree to these Terms and our Privacy Policy;
- If you are registering on behalf of an organisation, you have authority to bind that organisation.
We reserve the right to update these Terms at any time. We will notify registered users of material changes by email. Continued use of the Platform after such notification constitutes acceptance of the updated Terms.
3. What We Provide
Awesome Professionals provides a technology platform that:
- Allows Professionals to create profiles and list their services;
- Allows Clients to search for, contact, and engage Professionals;
- Facilitates communication and introductions between Clients and Professionals.
We are an introductory platform only. We are not a party to any service agreement between a Client and a Professional. We do not employ, supervise, or control Professionals, and we do not guarantee the quality, safety, or legality of any services provided through the Platform.
4. Accounts and Registration
4.1 Creating an account
To access most features of the Platform you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
4.2 Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [contact email] if you become aware of any unauthorised use of your account.
4.3 Account suspension and termination
We reserve the right to suspend or terminate your account at our discretion, including if we believe you have breached these Terms, engaged in fraudulent or harmful conduct, or if required by law.
5. Professionals
5.1 Eligibility
To list services on the Platform, Professionals must:
- Be at least 18 years of age;
- Hold any qualifications, registrations, or certifications required by law or professional bodies for the services they offer;
- Comply with all applicable UK laws and regulations, including those relating to safeguarding, data protection, and employment.
5.2 DBS checks
Professionals working with children or vulnerable adults are required to hold a valid enhanced Disclosure and Barring Service (DBS) certificate. By listing such services, you confirm that you hold a current, valid enhanced DBS check and you agree to provide evidence of this upon request. We reserve the right to remove listings or suspend accounts where DBS compliance cannot be evidenced.
Note for solicitor: The platform operator should consider whether to carry out verification of DBS certificates themselves or rely on professional self-declaration. Given the SEND and childcare context, active verification is strongly recommended and may be expected by users and regulators.
5.3 Accurate listings
Professionals are responsible for ensuring their profiles and service listings are accurate, honest, and up to date. Misleading, false, or exaggerated claims are strictly prohibited and may result in account termination and referral to relevant authorities.
5.4 Independent status
Professionals are independent contractors and not employees, agents, or partners of Awesome Professionals. You are solely responsible for your own tax obligations, insurance, and compliance with applicable laws.
6. Clients
6.1 Due diligence
While we take reasonable steps to support quality and safety on the Platform, Clients are responsible for conducting their own due diligence before engaging a Professional. We recommend that Clients:
- Review profiles, qualifications, and reviews carefully;
- Request and verify evidence of DBS certificates where relevant;
- Obtain and verify references;
- Ensure any Professional holds appropriate insurance for the services to be provided.
6.2 Your responsibilities
Clients agree to treat Professionals with respect, provide accurate information about their requirements, and pay agreed fees promptly. Abusive, threatening, or discriminatory conduct towards Professionals will result in account suspension.
7. Fees and Payments
Details of any platform fees, commission structures, or payment terms will be set out in a separate Fee Schedule, which forms part of these Terms. By using the Platform, you agree to pay any fees applicable to your use.
All payments processed through the Platform are subject to the terms of our payment provider. Awesome Professionals does not store payment card details.

8. Prohibited Conduct
You must not use the Platform to:
- Post false, misleading, or fraudulent information;
- Harass, abuse, threaten, or discriminate against any other user;
- Circumvent the Platform to engage Professionals directly and avoid applicable fees (after an initial introduction through the Platform);
- Scrape, copy, or reproduce Platform content without our written permission;
- Introduce malware, viruses, or harmful code to the Platform;
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
9. Safeguarding
The safety and wellbeing of children and vulnerable adults is of paramount importance to us. All users of the Platform agree to:
- Act in accordance with all applicable safeguarding legislation and guidance, including the Children Act 1989 and 2004, and the Care Act 2014;
- Report any safeguarding concerns immediately to the relevant statutory authorities;
- Co-operate fully with any safeguarding investigations.
We will report to the appropriate authorities any conduct that we reasonably believe poses a risk to the safety of children or vulnerable adults.
10. Intellectual Property
All content on the Platform — including text, design, graphics, logos, and software — is owned by or licensed to Awesome Professionals and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute our content without our prior written consent.
By submitting content to the Platform (including profile information, reviews, and service descriptions), you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with the operation of the Platform.
11. Privacy and Data Protection
We process personal data in accordance with our Privacy Policy and applicable UK data protection law, including the UK GDPR and the Data Protection Act 2018. Please read our Privacy Policy carefully before using the Platform.
12. Limitation of Liability
To the fullest extent permitted by applicable law:
- Awesome Professionals is not liable for any direct, indirect, incidental, special, or consequential loss arising from your use of the Platform or the services of any Professional found through the Platform;
- We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components;
- Our total liability to you in connection with these Terms shall not exceed the greater of £100 or the total fees paid by you to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Note for solicitor: Review limitation of liability clause carefully. Consumer protection legislation (Consumer Rights Act 2015) may restrict how liability can be limited, particularly for individual Clients who are consumers.
13. Disputes Between Users
Awesome Professionals is not responsible for resolving disputes between Clients and Professionals. In the event of a dispute, we encourage users to attempt resolution directly. We may, at our discretion, provide reasonable assistance in facilitating resolution but are under no obligation to do so.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
